Terms of Use for Jet Balls

Welcome to Jet Balls! These Terms of Use ("Terms") govern your access to and use of the mobile game application "Jet Balls" (the "Game"), developed by Betarland ("Betarland", "we", "us", or "our").

By accessing, downloading, installing, or using the Game, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms and our Privacy Policy, you may not access or use the Game.

1. Eligibility

You must be at least 13 years old to use the Game. If you are under 13, you must have your parent or legal guardian's permission to use the Game and they must agree to these Terms on your behalf.

2. Your License to Use the Game

Subject to your compliance with these Terms, Betarland grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Game for your personal, non-commercial entertainment purposes on a mobile device that you own or control.

3. Account and Google Play Games Integration

Google Play Games: The Game integrates with Google Play Games for authentication and cloud saving. By using this feature, you agree to Google's Terms of Service and Privacy Policy. Betarland does not store your Google Play Games login credentials.

Account Responsibility: You are solely responsible for maintaining the confidentiality of your Google Play Games account information linked to the Game and for all activities that occur under your account. You agree to notify Betarland immediately of any unauthorized use of your account.

4. Virtual Items and In-Game Currency

The Game may include virtual items or in-game currency (e.g., coins, diamonds) that can be purchased with real money or earned through gameplay. These virtual items and currency have no cash value and cannot be redeemed for real money or goods. Your purchase of virtual items is a purchase of a limited, personal, non-transferable, non-sublicensable, revocable license to use those virtual items solely within the Game. All sales of virtual items are final, and no refunds will be given.

5. User Conduct

You agree not to do any of the following:

  • Use the Game for any commercial purpose.
  • Copy, adapt, modify, decompile, reverse engineer, disassemble, or derive source code from the Game.
  • Violate any applicable law or regulation in connection with your use of the Game.
  • Interfere with or disrupt the Game or servers or networks connected to the Game.
  • Attempt to gain unauthorized access to any portion of the Game or any other accounts, computer systems, or networks connected to the Game.
  • Use any robot, spider, scraper, or other automated means to access the Game for any purpose without our express written permission.
  • Exploit any bug, glitch, or vulnerability in the Game for personal gain.
  • Harass, abuse, or harm another person or group.

6. Advertisements

The Game may display advertisements provided by Unity Ads or other third-party advertisement networks. By using this application, you consent to viewing advertisements displayed in the context of the application. More specifically, Unity Ads and potentially Google Ads are displayed to the user. This helps sustain the development of free-to-play applications. It is possible Google tracks users and analyzes data to target ads to them. If you object to the aforementioned, please uninstall the application immediately. Your continued use of this app is a clear indication of your agreement with these terms. We do not endorse any products or services advertised, and we are not responsible for the content of such advertisements.

7. Analytics and Data Collection (Firebase)

To improve the Game and your experience, Betarland collects anonymous usage data and crash reports through Google Firebase. This data helps us understand how the Game is used, identify bugs, and plan future updates. This information does not personally identify you. Please refer to our Privacy Policy for more details on data collection and usage.

8. Intellectual Property

All rights, title, and interest in and to the Game, including all copyrights, trademarks, trade secrets, and other intellectual property rights, are owned by Betarland or its licensors. You acknowledge that you have no ownership or other proprietary interest in the Game or any virtual items or currency appearing in the Game.

9. Disclaimers

THE GAME IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, BETARLAND DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY (I) WARRANTIES OF MERCHANTABILITY; (II) WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE; (III) WARRANTIES AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.

BETARLAND DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS, OR SERVICES, BE SECURE, ACCURATE, COMPLETE, FREE OF HARMFUL CODE, OR ERROR-FREE, OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BETARLAND OR ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE GAME, EVEN IF BETARLAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, OR OTHERWISE).

11. Termination

Betarland may terminate or suspend your access to all or part of the Game at any time, with or without cause, with or without notice, effective immediately. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kazakhstan.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. You are advised to review these Terms periodically for any changes. Your continued use of the Game after the posting of revised Terms means that you accept and agree to the changes.
